Terms of Service

Effective Date: August 20, 2025

These Terms of Service (“Terms”) constitute a binding legal agreement between you (“User”, “you” or “your”) and Moneytor Pty Ltd (ABN 70 690 032 163, “Moneytor”, “we”, “us” or “our”), governing your access to and use of the Moneytor personal finance platform (the “Service”). By accessing, registering, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Service, you agree to be legally bound by these Terms and all policies incorporated by reference. If you do not agree, you must not use the Service.

2. Eligibility

You represent and warrant that:

  • You are at least 18 years of age.
  • You are a resident of Australia.
  • You have the legal capacity to enter into binding agreements.

Identity Verification Disclaimer: Moneytor does not verify your identity. You are solely responsible for providing accurate and truthful information, and for ensuring that you have the right to use any personal or financial information you provide.

3. Account Registration & Security

  • You must register an account to use the Service and provide accurate, current, and complete information.
  • You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
  • You must immediately notify Moneytor of any unauthorised use or security breach.

4. Subscriptions & Billing

  • Access to some features requires a paid subscription.
  • Subscription fees are payable in advance and automatically renew unless cancelled.
  • Subscription fees are non-refundable, except where required under the Australian Consumer Law.
  • Cancellation prevents future renewals but does not entitle you to a refund for the current billing period.
  • Payments are processed securely via Stripe or other authorised payment processors.

5. Use of the Service

Moneytor grants you a non-exclusive, non-transferable, revocable licence to use the Service solely for private and personal financial management. You must:

  • Use the Service in accordance with these Terms and applicable laws.
  • Ensure all information you provide (including manual entries) is accurate.
  • Accept full responsibility for your own financial decisions.

No Financial Advice: Moneytor does not provide financial, investment, tax, or legal advice. Any insights or outputs from the Service are general in nature and must not be relied upon as professional advice. You should obtain independent professional advice before making financial decisions.

6. Prohibited Uses

You must not:

  • Use the Service for unlawful, fraudulent, abusive, or misleading purposes.
  • Attempt to gain unauthorised access to the Service or its systems.
  • Interfere with the operation, integrity, or security of the Service.
  • Share, resell, or misuse the Service in a commercial capacity.

7. Financial Data Handling

(a) Open Banking / Consumer Data Right (CDR)

  • Moneytor uses Fiskil, an accredited CDR data provider, to access financial data.
  • You must provide explicit consent before Moneytor accesses such data.
  • You may withdraw consent at any time, but this may limit Service functionality.
  • Moneytor is not responsible for the accuracy, timeliness, or completeness of data sourced via CDR providers.

(b) Manual Data Entry

  • You may input financial data manually.
  • You are solely responsible for the accuracy and completeness of manual entries.
  • Moneytor disclaims liability for errors or consequences arising from inaccurate manual data.

(c) Future Features

  • Moneytor may introduce new features in the future that change the way your data is processed, displayed, or analysed. Your continued use of the Service constitutes acceptance of such changes.

8. Insights, Suggestions & Artificial Intelligence

  • The Service may generate insights, summaries, or suggestions, including those powered by artificial intelligence (“AI”) tools.
  • Such outputs are provided for informational purposes only.
  • You acknowledge that AI-generated content may be incomplete, outdated, or inaccurate, and should not be relied upon as financial advice.
  • Specific details of what data AI processes are set out in our Privacy Policy.

9. Intellectual Property

  • All intellectual property rights in the Service, including software, branding, content, and design, are owned by Moneytor or its licensors.
  • You may not copy, reproduce, modify, distribute, or create derivative works from the Service without prior written consent.

10. Privacy & Data Protection

  • Moneytor complies with the Privacy Act 1988 (Cth) and other applicable privacy laws.
  • Moneytor complies with obligations under the Notifiable Data Breaches scheme.
  • Please refer to our Privacy Policy for details on how we collect, use, store, and disclose personal data, including how we handle security incidents and breach notifications.

11. Disclaimers & Limitation of Liability

  • The Service is provided on an “as is” and “as available” basis.
  • Moneytor does not guarantee uninterrupted availability, accuracy of insights, or error-free operation.
  • To the maximum extent permitted by law:
    • All implied warranties are excluded.
    • Moneytor’s liability is limited to resupplying the Service or refunding fees (where required by law).
  • Nothing in these Terms limits your rights under the Australian Consumer Law.

12. Indemnification

You agree to indemnify and hold harmless Moneytor, its directors, employees, and agents from and against any claims, liabilities, damages, costs, and expenses arising from your breach of these Terms, misuse of the Service, or violation of applicable laws.

13. Termination & Suspension

  • Moneytor may suspend or terminate your account immediately if you breach these Terms, misuse the Service, or where required by law.
  • You may terminate your account at any time via the Service.
  • Termination does not affect accrued rights or obligations.

14. Dispute Resolution

Before commencing formal proceedings, you agree to first contact Moneytor at support@moneytor.com.au to attempt to resolve the matter informally. Only if a resolution is not reached within a reasonable period may either party escalate to the courts.

15. Governing Law

These Terms are governed by the laws of Victoria, Australia, and you submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.

16. Amendments to Terms

Moneytor may amend these Terms from time to time. Updates take effect upon posting to the Service or notification to you. Continued use of the Service constitutes acceptance of the updated Terms.
